Determining Custody
Before custody is determined, the court may investigate both parents. That is, the court will take into consideration any issues or faults that may have caused the marriage to fall apart, as well as look at both parents’ abilities to provide for their children.
If both parents are deemed suitable guardians, the mother generally gets custody by default. If the child is a teenager, though, he or she may choose to live with either parent. It is important to note that this may not be the case when the court determines that one parent would not be a good guardian for the child.
